3. IDC POINTS AND THE INFORMATION
3.1 A Program Member's IDC Points which have not been used by
the Program Member will be forfeited under the following circumstances:
a) Termination of services in the Program Member's relevant
customer account(s) for any reason whatsoever, including without limitation
reason of a transfer of the IDC Circle subscription;
b) Expiry of the validity period of the IDC Points;
c) Breach of the terms and conditions herein or any terms and
conditions of service by the Program Member;
d) Termination of the IDC Circle; and
e) Any other circumstances as determined by the IDC
3.2 The Program Member bears full responsibility for the
keeping and use of the IDC Points, User ID and Password allotted to him/her or
use by him/her to access the Online Address. IDC bears no responsibility
whatsoever for any loss or forfeiture of IDC Points or for any unauthorized
redemption and/or usage of IDC Points (whether using the User ID or otherwise)
and shall not be obliged to provide any refund or re-allocation of IDC Points in
cases of forfeiture by the IDC or any person in accordance with the terms and
conditions herein.
3.3 IDC may from time to time include on the IDC Circle other
items and entitlements from IDC and/or third parties (the “Third Parties”) that
can be redeemed on the IDC Circle using IDC Points (the “Extra Items”). The
redemption of these Extra Items will be done through eVouchers (the
“eVouchers”). The eVouchers stating the serial number, the entitlements/items
description and redemption instructions will be issued and sent by email only to
Program Members at the email address provided when registering. Only genuine
eVouchers bearing the IDC Circle name will be accepted by the participating
Third Parties. The use of the eVouchers shall be subject to the terms and
conditions stated therein.
3.4 Unless otherwise specified, eVouchers cannot be
a) combined in respect of one purchase;
b) used to purchase any items on sale or special offer; and
c) used in conjunction with any discount card, offer voucher or similar scheme.
3.5 eVouchers are valid from the date of issue and up to the validity period
stated on the voucher unless otherwise stated. IDC and the Third Parties shall
not be under any obligation whatsoever to extend the validity of the eVouchers.
3.6 eVouchers are neither refundable nor exchangeable for cash or credit. In the
event that an entitlement/item is not available for any reason, IDC reserves the
right to substitute the Program Member's entitlements/items with alternative
entitlements/items of equivalent value.
3.7 Any costs in excess of the eVoucher value and all ancillary costs associated
with redeeming the eVoucher are the responsibility of the Program Member, and
the Program Member shall make payment of any outstanding amount separately
should the total amount of the bill or purchase exceed the value of the
eVoucher.
3.8 Any taxes, levies or duties to be paid in respect of the receipt of
entitlements/items or benefits shall be borne by the Program Member.
3.9 IDC shall not be obliged to replace an eVoucher which has been lost,
defaced, torn, damaged or stolen for whatever reason, and shall not be obliged
to provide refunds or substitutions of entitlements/items that are not fully
utilized.
3.10 IDC shall not be obliged to replace an eVoucher or award IDC Points which
the Program Member failed to receive for any reason whatsoever, including but
not limited to the Program Member’s failure or neglect to notify the IDC of a
change of email address, or the Program Member’s failure to enter a correct
and/or valid email address when registering at the Online Address.
3.11 IDC shall not be obliged to entertain any request once the eVoucher has
been issued or once IDC Points have been deducted from the Program Member's
designated account whichever is earlier.
3.12 As some of the entitlements/items under the IDC Circle may be provided by
Third Parties, IDC will not be responsible for such entitlements/items
and will not be liable for any loss or damage of whatsoever nature and
howsoever caused (including without limitation, negligence) arising directly or
indirectly from or in relation to such entitlements/items. Program Members
should carefully review the Terms and Conditions of Third Parties governing
entitlements/items provided by Third Parties.
